This puppy is being sold with Full ____ Limited __X__ registration. (Limited registration means breeding/show rights are not included) Short Term Health Contract
5 day Health Warranty. This dog is guaranteed to be in good health, to the best of my knowledge at the time of this sale, and has had initial inoculations against distemper, hepatitis, para/parvo virus and received DE-worming as noted on the health record you received. You, the Buyer, are required to take the puppy to a licensed Veterinarian for first exam within five days of possession. If the puppy is found to have a health problem that would cause it to be a poor health risk due to illness, disease, or congenital disorder that is clearly attributable to the Seller, the Buyer may return the puppy to the Seller, for a full refund of purchase price. The Buyer must contact the Seller immediately and provide a written statement from a licensed Veterinarian stating the defect or illness along with documentation of any tests and their results. A puppy must be returned within 48 hours of exam along with its AKC paperwork. All transportation costs and veterinarian bills are the responsibility of the Buyer, and are non-refundable. Parvo is not covered under this 5 day Health Warranty but is covered under the Parvo Virus Agreement below. Seller will not be responsible for any illness or health problems diagnosed after this time period, except where stated in this contract. Failure to have puppy examined will void the Warranty.
Buyer understands that young puppies are very susceptible to many different kinds of parasites and they are commonly found in young puppies, and preventive measures have been undertaken by us. However... we recommend you consider having a stool sample checked at the first exam to help assure parasites are not present.____
Buyer understands that during the transition of a puppy to its new home it is stressful on the puppy, and can sometimes leave the Buyer vulnerable to extra costs, inconveniences, and frustrations. Buyer understands that despite everyone's best efforts, occasionally the best option may be to return a puppy to us for full refund of purchase price. Buyer accepts full responsibility if they decide they are unwilling or unable to return the puppy to us on those occasions, and acknowledges the Seller is then under no further obligation. ____
Parvo Virus Agreement - Parvo is a canine virus that is commonly thought by many veterinarians to have an incubation period of 3 - 7 days. Should your puppy be diagnosed with Parvo, the Buyer and Seller agree to the following terms:
A positive Parvo test along with a Complete Blood Count test (CBC) that shows a low white blood cell count (WBC), will be considered an accurate diagnosis. The medical file along with all test results will need to be released to us, and for any reimbursements we will require an itemized invoice.
1) If the puppy breaks with Parvo between 1 - 4 days(96 hrs) after leaving our premises, then it probably did not contract the virus at your location, you must notify us immediately and you may then return the puppy for a 100% refund of purchase price OR if you decide to keep the puppy, we agree to pay 75% of the initial tests, medical procedures, and medication costs directly related to the diagnosis and treatment. Total combined reimbursement will not exceed $900. 2) If the puppy breaks with Parvo between 5 - 7 days after leaving our premises, then it is less clear whether the puppy contracted the virus at your location or otherwise, you must notify us immediately and you may then return the puppy for a 50% refund of purchase price OR if you decide to keep the puppy, we agree to pay 50% of the initial tests, medical procedures, and medication costs directly related to the diagnosis and treatment. Total combined reimbursement will not exceed $600. 3)We will not make any compensation for parvo that breaks or is reported to us more than seven days after leaving our premises.We will not pay for Vet exam fees, any general indirect vet fees or tests. It covers the tests for diagnosis & direct treatment only. 4) We will not pay for Vet exam fees, any general indirect vet fees or tests. It covers the tests for diagnosis & direct treatment only.
Buyer accepts full responsibility for all risks associated with declining to return a puppy, they also acknowledge the possibility the puppy could pass away despite efforts to treat it, and agree Seller is under no further obligation other than reimbursement of vet bills as stated above. Buyer understands that a puppy at this age may or may not have some immunity to parvo despite receiving its first vaccine. You understands it is important to refrain from exposing the puppy to public places until after the puppy has completed its 3rd puppy vaccination ( dog parks, training classes, vet floor, pet store etc). Buyer understands that any public places, including apartment complexes where other dogs frequent, put the puppy at risk for Parvo, and those that have just moved into a new home or apartment in the last year or so are at higher risk. ____
Buyer is aware that Vets charge widely varying fees for the treatment of Parvo, as it is big business for some offices. It is wise to call around and get quotes for treatment. Charges can vary by hundreds to thousands of dollars, and you have every right to take a puppy to another office for treatment if need be, even if treatment has been started elsewhere. Be very suspicious of any vet office that discourages you from calling around and getting quotes, or discourages you from the possibility of taking the puppy somewhere else, or is quoting you very high estimates without discussing variables that would or could lower costs. Some offices are willing to bill you by the day for each days charges, and some will require a huge down payment up front! There are lots of variables. ____ Long Term Health Contract This puppy has a Warranty until 1 year of age against life threatening/altering congenital defects. Seller will not be responsible for illness or health problems of any kind that are diagnosed after this time period. All shipping or transportation costs and veterinarian bills are the responsibility of the Buyer and are non-refundable.
In the case of an unexpected, UN-explainable death the Buyer will have it autopsied to ascertain reason. IF the death is due to a congenital defect , the Seller will provide a replacement puppy of the same sex and value as soon as a comparable puppy is available and will pay 90% of the autopsy cost.
Should the veterinarian discover an unforeseen congenital abnormality that is currently life threatening or is currently affecting the animal’s quality of life, we will offer you a choice of a replacement puppy when one is available or a 50% cash refund of the price of the puppy. The dog must currently display signs of illness, stress, and/or pain making it unable to lead a normal healthy life.
The 1 year Warranty covers life threatening/altering congenital defects only and does not cover things such as but not limited to: Illnesses or disorders that are or could be caused by environmental factors such as allergies of any kind, immunity levels, autoimmune disorders, bloat, pneumonia, heatstroke, infectious diseases, viruses, parasites of any kind, accidental injuries, foreign inhalation, indigestion of harmful substances, heat exhaustion. Mild heart murmurs with no heart disease symptoms or signs of progression and under-bite or over-bites that are not life threatening or affecting the animal’s quality of life (meaning not showing signs of illness, stress, and/or pain in the dog) are not included.
For all reimbursements: you will provide an invoice, you will release medical files containing tests and results. and we reserve the right to request a licensed vet make all claims in writing, . We reserve the right to base reimbursements on local Strasburg Vet Clinic fees.
Buyer agrees to insure the puppy’s good health by taking good care of the puppy and providing appropriate premium food, housing, and medical care. As a responsible puppy owner/buyer you must provide your puppy with routine preventive care and all vaccinations and annual physical examinations by a licensed veterinarian, failure to do so will void this warranty.
Pet puppies are sold on limited registration only. You are hereby agreeing to spay or neuter your puppy by 8 months of age. Failure to comply with this agreement will be considered a breach of the Contract, will void the Health Contract, and may result in litigation.
Buyer agrees to indemnify and hold harmless Box Elder Creek Boxers, the Shockman’s and their estate, from any and all loss, damage, and expense whatsoever from the acts of any kind whatsoever, any and all claims, presentation or demand from any person whomever, including Buyer, arising out of having to do with the prior or present care, breeding, training, mortality, capacity and health of said puppy.
In the event of any litigation in connection with this contract, both the Seller and the Buyer shall each be responsible for their own attorney’s fees and costs. The venue and jurisdiction for litigation shall lie exclusively in Adams County, Colorado. In the event the Buyer prevails in litigation, the total awarded value shall not exceed the value of the original purchase price, less any reimbursements already made by Seller to Buyer.
Any umbilical hernia or un-descended testicles will be marked as such below. They are common in puppies, are rarely life threatening and may correct themselves over the next few months, If Vet determines it prudent to correct at the time of spaying or neutering, we will reimburse up to the following to cover the extra cost to fix it at the time of spay/neuter surgery. If the extra cost is less, we will choose the lesser cost.
I hereby acknowledge that I have read, understand, and agree to the terms of this document. Further, I accept the terms and conditions of the warranty for congenital disorders printed in this document and I waive and relinquish any other rights that I might otherwise have in the event of such occurrence.
